What Qualifies as "Undue Hardship"

Substantial Financial Loss

You must show that paying the tax on the due date would result in a substantial financial loss — e.g., selling property at a sacrifice price, liquidating a business at a loss, or losing a home to foreclosure.

Not Just Inconvenience

Being short on cash or having to borrow money is NOT undue hardship. The IRS expects you to borrow, use credit cards, or liquidate non-essential assets to pay your tax bill on time.

Serious Medical Emergency

A catastrophic illness or accident that prevents you from accessing funds or making financial decisions may qualify — but you need medical documentation.

Natural Disaster / Casualty

IRS frequently grants 1127 extensions after federally declared disasters. FEMA disaster declarations are strong supporting evidence.

Form 1127 Filing Rules

Maximum Extension

Up to 6 months from the original due date. No further extensions are available — if you can't pay after 6 months, you need an installment agreement.

Filing Deadline

Must be filed ON OR BEFORE the tax payment due date. The IRS will not grant retroactive extensions — if the due date has passed, Form 1127 is no longer available.

Interest Still Accrues

The extension only delays the payment deadline — it does NOT stop interest from accruing. Interest runs from the original due date until the tax is paid in full.

Late Payment Penalty

The 0.5% per month failure-to-pay penalty is suspended during the approved extension period. But if you don't pay by the extended date, the penalty applies retroactively.

Form 1127 vs. Installment Agreement

Form 1127 gives you a lump-sum extension. An installment agreement lets you pay over time. If your hardship will last longer than 6 months, an IA is the better option.

State Taxes

Form 1127 is federal only. Each state has its own payment extension process. A federal 1127 approval does NOT affect your state tax payment deadline.
